The Supreme Court has issued a strong directive to the Centre and Delhi Police, demanding a more robust and preventative approach to tackle rising crimes against women in the National Capital Region. The apex court stressed that authorities must ensure women feel safe, even when walking alone late at night or using public transportation.

A bench, presided over by Justice JB Pardiwala, initiated a suo motu case following a series of recent rape incidents in Delhi-NCR. The court expressed concern over a perceived lack of safety for women, particularly in vulnerable areas of the city.

Prioritizing Prevention Over Reaction

The court firmly advised that the focus of law enforcement agencies should shift from merely reacting to crimes after they occur to actively preventing them. “We must ensure every woman in NCT Delhi feels safe, whether walking at 10 PM or travelling by metro or road,” the bench stated, underscoring the paramount importance of creating a secure environment.

The Supreme Court pointed out that systemic deficiencies should not inadvertently facilitate the commission of crimes. “Deficiencies, if any, should not facilitate commission of crime,” the court observed, reiterating, “What is important is to prevent crime, not what you do after crime is committed.”

Creating a Strong Deterrent

A key emphasis was placed on establishing a powerful deterrent for potential offenders. Justice Pardiwala articulated the need to instill a palpable fear among criminals, suggesting that they must believe that severe consequences, including death, would follow any such act. “Unless you don’t create such fright in the minds of criminals ki ab kuch kiya toh mar jayengey... you will not be able to prevent such crimes,” he remarked.

The judge further elaborated on the necessity of creating “a fright, a fear in the mind of a man who is prone to commit such offences.” This indicates a call for more stringent and visible enforcement measures to dissuade perpetrators.

Firm Action Against Accused

The Supreme Court also directed the Delhi Police to adopt a firm stance against individuals accused of serious crimes against women. The court acknowledged the importance of Article 21, which guarantees the right to life and personal liberty, and suggested that authorities should not be deterred by potential criticism from human rights groups when taking strict action.

This directive signals a clear mandate for decisive action against rape and other grave offences, prioritizing public safety and the constitutional rights of women. The court's intervention highlights the urgency of addressing the current security landscape for women in Delhi.
