Hollywood actor and music artist Will Smith is facing a civil lawsuit from a touring violinist who alleges he was fired after reporting a disturbing incident that he believes amounted to sexual harassment and assault during Smith’s recent concert tour.
Brian King Joseph, an accomplished violinist who had joined Smith’s Based on a True Story 2025 tour, has filed a complaint in a Los Angeles court against Smith and his management company, Treyball Studios Management. The lawsuit, filed on December 31, accuses the defendants of wrongful termination, retaliation, and sexual harassment, according to court documents reviewed by multiple U.S. media outlets, including USA Today.
Allegations Linked to Las Vegas Hotel Incident
According to the complaint, the incident at the center of the lawsuit occurred in March 2025 while the tour was in Las Vegas. Joseph claims that when he returned to his hotel room—arranged and paid for by the tour’s management—he found signs that someone had entered without his consent.
The filing alleges the room contained a handwritten note addressed to him, along with personal items such as wipes, a beer bottle, prescription HIV medication bearing another individual’s name, and hospital discharge paperwork belonging to someone else. Joseph states he immediately alerted hotel security, tour officials, and later contacted police through a non-emergency line.
The lawsuit contends that rather than initiating a proper investigation, members of the tour’s management accused Joseph of fabricating the incident and blamed him for what had occurred.
Claims of Retaliation and Termination
Joseph alleges that only days after reporting the matter, he was dismissed from the tour. Management reportedly told him that the production was “moving in a different direction.” The violinist disputes this explanation, claiming a replacement musician was hired shortly thereafter, which he argues undermines the stated reason for his termination.
The lawsuit frames his dismissal as retaliation for raising safety and misconduct concerns—an allegation that, if proven, could have serious legal implications under California labor and employment laws.
Broader Allegations of Inappropriate Conduct
Beyond the Las Vegas incident, the complaint further alleges that Smith engaged in what Joseph describes as “grooming behavior” beginning shortly after they met in November 2024. According to the filing, Joseph was initially hired for a performance in San Diego and later invited to join the full tour and participate in Smith’s upcoming music projects.
Joseph claims that over time, Smith encouraged increasingly private interactions and made remarks suggesting an unusually personal bond. These allegations form the basis of the sexual harassment claim outlined in the lawsuit. No criminal charges have been filed.
Impact on Touring Safety and Accountability
The case highlights broader concerns about artist management structures and the vulnerability of touring performers, who often depend on centralized management for housing, security, and continued employment. Legal experts note that retaliation claims tied to reporting misconduct are taken seriously by courts, particularly in industries where power imbalances are common.
Joseph is seeking damages for emotional distress, post-traumatic stress disorder (PTSD), and economic losses, with the amount to be determined by a jury.
Response Awaited from Will Smith’s Team
As of publication, Will Smith and Treyball Studios Management have not issued a public response to the allegations. Media inquiries seeking comment have not been answered, according to USA Today and other outlets. Smith has not been formally accused of criminal wrongdoing, and the claims remain allegations to be tested in court.
The case is expected to draw close attention, given Smith’s global profile and the ongoing scrutiny of workplace conduct within the entertainment industry.
