Supreme Court Mandates Swift Action on Illegal Constructions
The Supreme Court has adopted a stringent stance against unauthorized constructions and land use violations in residential areas across the country, including the capital Bhopal. A bench comprising Justices Ahsanuddin Amanullah and R. Mahadevan expressed significant concern over administrative laxity, stating it would not be tolerated under any circumstances.
The court emphasized that mere paperwork is insufficient; immediate and effective action on the ground must be ensured. During the hearing, the court questioned the functioning of municipal corporations and administrative mechanisms in various Indian states, rebuking them for non-compliance and rule violations. Consequently, warnings were issued to the Chief Secretaries of Haryana, Punjab, Uttarakhand, and Mizoram.
Furthermore, notices for contempt of court were served to the Commissioners of Gurugram and Lucknow Municipal Corporations. Jaipur, Greater Noida, and Patna Municipal Corporations also faced the court's displeasure, indicating leniency towards illegal constructions.
Timed Action Ordered on Illegal Constructions
The Supreme Court underscored that violations of master plans and land use regulations are unacceptable under any circumstances. It directed that action be completed within a specified timeframe for all identified illegal constructions. Some cases were assigned deadlines ranging from 24 hours to four weeks, highlighting the urgency of the issue.
The court clarified that if buildings sealed due to illegal constructions are reopened, an FIR will be registered against the individuals involved. This directive is a crucial step towards ensuring administrative accountability and compliance with regulations.
Question Raised on Coaching Institute Operations in Jaipur
The court also questioned the operation of coaching institutes in commercial land use zones in Jaipur. Directions were issued for the relocation of institutes within a coaching hub constructed at an estimated cost of INR 500 crore to ensure adherence to land use norms and the designated purpose of various zones.
Residential Land Use Case in Bhopal Under Consideration
In Bhopal, a case concerning commercial activities and unauthorized constructions on residential plots, particularly in Arera Colony and other city areas, is under judicial review. The hearing on August 5, 2026, was based on a petition filed by Vivek Tripathi, a resident of Arera Colony, who alleged rule violations and changes in land use for construction in residential zones. The petition claims that despite complaints, local municipal and district administrations failed to take necessary action, leading to the court's involvement.
Administrative Pressure and Future Expectations
The Supreme Court's firm stance has intensified pressure on municipal corporations and administrative departments in Bhopal and other cities. Swift action is now anticipated in cases of illegal constructions, reopening of sealed buildings, and land use violations. The situation is expected to become clearer upon the issuance of detailed orders by the court.
