NEW DELHI – An Indian court has ordered that bankruptcy petitions filed against SpiceJet by aircraft lessors be reheard by a new bench. The decision came after the airline reached a last-minute settlement with one of the lessors, creating a new procedural landscape for the ongoing legal battles.
This development represents a significant setback for numerous aircraft leasing companies that have been engaged in a protracted dispute with India's fourth-largest airline to reclaim outstanding debts. However, it provides a crucial reprieve for SpiceJet, allowing its current management to maintain control while the petitions undergo fresh scrutiny.
Setback for Lessors, Reprieve for Airline
The National Company Law Tribunal (NCLT) had been on the verge of delivering a judgment concerning eight petitions lodged against SpiceJet. However, the withdrawal of one of these petitions, following an undisclosed settlement, necessitated a complete revision of the prepared ruling.
A judge indicated that with one member of the judicial panel scheduled to retire on Wednesday, there was insufficient time to rewrite and issue the comprehensive judgment. Consequently, the remaining petitions must now be presented and heard anew by a different bench.
Market Reaction and Airline Statement
Following the court's order, SpiceJet's shares, which had been trading lower, pared some of their losses. The stock was seen trading down 2.1% at 10.95 rupees. The airline, in a statement, hailed the court's decision as a "positive step" towards resolving outstanding matters.
A spokesperson for SpiceJet emphasized the company's ongoing commitment, stating, "(We) remain committed to working closely and constructively with our partners to find mutually acceptable solutions." The specific financial amount claimed by the lessors was not immediately disclosed.
