CM Mohan Yadav Meets OBC Representatives on Reservation Restoration

Bhopal | October 16, 2026 - Madhya Pradesh Chief Minister Dr. Mohan Yadav held a significant meeting today with representatives of the Other Backward Classes (OBC), petitioners in the reservation case, and social organizations. The meeting was convened following a recent High Court decision that impacted the status of reservation.

The discussions primarily focused on the restoration of the 27% OBC reservation, the future of affected candidates, and future legal and policy strategies. OBC representatives presented their key demands to the Chief Minister, emphasizing that simply filing an appeal in the Supreme Court against the High Court's decision would not be sufficient.

They stressed the need for comprehensive and concrete action to address the legal and factual questions raised by the court. The representatives believe that presenting a strong constitutional solution for the restoration of reservation is paramount.

Key Demands for Reservation Restoration

OBC representatives put forth several crucial suggestions for the restoration of reservation, with the following being the most prominent:

  • Effective Legal Advocacy in the Supreme Court: A panel of senior advocates and constitutional experts should be formed to challenge the High Court's decision. This panel must submit a robust, fact-based, and highly relevant appeal to the Supreme Court to safeguard OBC reservation rights. The advocacy must be powerful enough to satisfy the court and re-establish the constitutional basis of reservation.
  • New Survey and Data Collection: An updated, scientific, and comparative survey of the social, educational, and economic status of the OBC community should be conducted. This survey will accurately assess their representation in government services. An expert committee or a competent commission should be formed for this purpose, ensuring the collected data can withstand judicial scrutiny. Current data may be outdated, making the collection of new and reliable figures critically important. This survey will not only reflect current representation but also form the basis for future policy formulation.
  • Ordinance and Legislative Solution: Based on the data from the new survey, recommendations from experts, and necessary constitutional procedures, a new ordinance or legislative proposal for 27% OBC reservation should be prepared. The objective is to rectify the shortcomings identified by the court and provide a solid legal foundation for the reservation. This step will offer a stable and secure legal framework for OBC reservation, capable of facing any future legal challenges.
  • Protection of Affected Candidates' Interests: Immediate action must be taken regarding available legal options for candidates affected by the High Court's decision. Necessary steps should be taken to protect their interests in recruitment processes to prevent jeopardizing their future. The situation of these candidates is extremely delicate, and the government must prioritize addressing their concerns. This may include considering amendments to recruitment rules or special provisions.
  • Consultation with the National Commission for Backward Classes: When preparing any reservation proposal, mandatory consultation with the National Commission for Backward Classes, in line with constitutional provisions, should be undertaken. This step will lend constitutional validity to the proposed solution. The commission's expertise and advice can be crucial in the matter of OBC reservation and will ensure any proposed measure is within the constitutional framework.

Special Recommendations from OBC Mahasabha

The OBC Mahasabha also presented specific recommendations to provide relief to affected candidates. According to the Mahasabha, a legal review of previously issued recruitment processes and available vacancies should be conducted.

If it's not possible to adjust affected candidates within current vacant positions, the possibility of creating additional or supernumerary posts in accordance with rules, rosters, and court orders should be considered. This would offer a practical option for accommodating affected candidates. This is a constructive suggestion that attempts to provide justice to affected candidates while remaining within the existing legal framework.

Stance of the OBC Mahasabha

Lokendra Gurjar, a national core committee member of the OBC Mahasabha, stated after the meeting that the OBC community is struggling for the restoration of 27% reservation at both judicial and democratic levels. He expressed the expectation that the government would prepare a clear action plan on this issue and make time-bound decisions, considering the future of the affected youth.

Gurjar emphasized that the OBC community will not be satisfied with mere assurances but requires a concrete constitutional solution that can withstand judicial scrutiny and pave the way for reservation restoration.

He added that the OBC Mahasabha will closely monitor the government's upcoming actions and decisions and will continue its legal struggle and phased movement to secure the restoration of 27% OBC reservation and justice for affected candidates. “Effective advocacy, updated data, and a strong constitutional solution are essential for the restoration of 27% OBC reservation,” he said. The Mahasabha believes that the appellate process alone will not suffice; a holistic approach is needed, encompassing data collection, legislative measures, and constitutional advice. This is a complex issue requiring a multi-faceted strategy.
