Law to Protect CAs from Police Harassment Demanded in Lok Sabha

Demand for Legal Protection for Chartered Accountants

Bhopal MP Alok Sharma raised a strong demand in the Lok Sabha on Wednesday, under Rule 377, for the creation of effective legal protection for Chartered Accountants (CAs) against unnecessary police harassment. He urged the government to address this long-standing and significant issue faced by the CA community.

Addressing the House, MP Alok Sharma stated that Chartered Accountants play an invaluable role in strengthening the nation's economy, tax system, financial discipline, and transparency. Despite this, it has been observed that in disputes between clients and CAs, where the CA may not have any direct fault, they are often unnecessarily harassed by the police.

He remarked that making CAs wait for hours at police stations or subjecting them to mental pressure in such cases is against the dignity of any respected professional. CAs perform their professional duties based on documents and information provided by the client. If the client presents incorrect information or documents, it is not appropriate to place the entire responsibility on the CA without a fair investigation.

Insisting on Fairness in Action Against CAs

MP Sharma emphasized that before taking any action against a CA, a thorough and impartial investigation into their actual role, the information they received, and their responsibilities must be conducted. He advocated for clear guidelines for the police and other investigation agencies to prevent CAs from being unnecessarily summoned to police stations for questioning solely based on professional relationships or client disputes.

He also stated that Chartered Accountants cooperating with investigations should be treated with respect and summoned for questioning only through the prescribed legal process. Clear and effective legal protection is extremely necessary to prevent undue harassment of innocent CAs while ensuring adherence to the law.

Issue Resonates in Both Houses of Parliament

This matter was listed third among the issues raised under Rule 377 in the Lok Sabha. The Speaker ordered that the matters raised under Rule 377 be laid on the table of the House. It is noteworthy that earlier, Rajya Sabha MP Vivek Tankha had also raised the issue of the need for a protection law for Chartered Accountants in the Rajya Sabha.

Thus, this long-standing demand of the CA community has now been raised in both Houses of Parliament, underscoring its significance. MP Alok Sharma reiterated his appeal to the central government to formulate clear legal protection, a defined investigation process, and necessary guidelines for the police and administration, keeping in mind the professional duties of Chartered Accountants. The aim is to ensure that action is taken only against actual wrongdoers and that innocent professionals do not face unnecessary mental and professional harassment.
